Terms & conditions

Great customer service and your privacy and security are important to Rooma and so the following terms and conditions are designed to make the Rooma web site a safe and easy place to shop.

Please read through them carefully before placing your order. By using this website and/or placing an order you agree to be bound by the terms and conditions set out below. Please also read our Privacy Policy Statement regarding personal information provided by you.

Before placing an order, if you have any queries relating to these terms and conditions, please contact our Customer Services team.

We may change these terms from time to time without notice to you. Changes will apply to any subsequent orders received and will be governed by that new version.

General

You agree that e-mail will be used as the standard means of communication.

Prices and availability of goods are subject to change without notice. A delivery charge will be added to your order value where appropriate.

Receipt of the order confirmation email is notification that we have received your order. It is not confirmation that your order has been accepted. We reserve the right to reject any offer of purchase by you at any time. We cannot fulfil any obligations due to the following reasons:

•    The product you ordered being unavailable from stock
•    Our inability to obtain authorisation for your payment
•    The identification of a pricing or product description error
•    Customers who fail to reach any order criteria set out in the Terms & Conditions

Products and services

Descriptions
We try to show products on the website as clearly and as accurately as possible. Despite this, slight variations may occur. The colour of an item may vary in accordance with the settings of your computer, monitor, software or printer from the colour of the actual product you receive.

All sizes of products specified on the website are approximate only. If measurements need to be exact, please contact us prior to ordering and we will do our best to help. Email [email protected] or  telephone 01769 540022. We will not be liable for the cost of returning items that are not the right size for your purposes if you have not checked with us beforehand.

We continue to develop our products and reserve the right to amend the specification of Products without prior notice in relation to future sales.

Product usage
This is in addition to your statutory rights. Our Products are intended solely for domestic use in the UK and we give no guarantees or undertakings in respect of the use of our Products for commercial purposes. By agreeing to these terms and conditions, you agree that we are in no way responsible for any non-domestic or commercial use of our Products and that you have no rights to cancel this purchase if you are purchasing the Product in a business capacity.

Data Privacy

Customer information is kept strictly confidential. Rooma Style Limited do not store credit card information and we do not and will not pass or sell your details on to any third party.

We abide by the requirements of the Data protection act 1998.

When you create an account we will sign you up to our e-newsletters, but you may unsubscribe from these at any time by clicking the link in the email.

Ordering and payment

Payments for orders through the website can be made through Sage pay using Visa, Mastercard, Delta, Visa Electron, Solo and Switch or via Paypal.

Payment will be debited from your account immediately by on placing the order. We charge for the order in full at the time the order is placed. Therefore please ensure if you are pre-ordering an item that you are happy to pay for it in advance.


Ordering and payment for Made-to-Order Items
Once you have selected and placed your order for a bespoke or made-to-order item, your payment will be taken. Upon us receiving your order we will arrange for fabric swatches of fabrics used in the item to be shipped to you. This applies to made-to-order items only. Fabric swatches will not be available for off the shelf items.

You will receive a link via email to our Made-to-Order Acceptance Form where you will need to complete your details and submit to us to confirm that you have seen and are happy with the fabrics.
Please note: in some instances fabrics can vary very slightly depending on colour/design.


You undertake that all details which you provide to us for the purpose of ordering goods are correct, that the credit or debit card you are using is your own and that there are sufficient funds to cover the cost of the order.

Your statutory rights are not affected but otherwise all purchases are non-exchangeable, non-refundable and non-transferable.

All prices on this site include United Kingdom VAT at the prevailing rate.

We do not accept payment by cheque or via telephone orders.

Discount Codes

If you have a discount code, then it must be entered into the voucher code box in the ‘shopping basket’ and must be done so at the time of ordering.  You must be logged in to your account in order to use a discount code. We will not be able to apply a discount code to an order after it has been processed and no refunds will be given. Promotional codes are not valid against shipping rates. Only one Discount PromoCode can be used at a time on any order.

Delivery

Rooma Style Limited deliver to most areas of UK Mainland.

Rooma Style Limited aims to deliver all orders, excluding large items such as furniture, within 7 working days of confirmation that your order has been accepted, but during busy periods delivery may take slightly longer.

In the event that an item is out of stock, we will notify you of the delay and despatch it as soon as it arrives.

Rooma Style Limited aim to deliver in-stock large items within 4 weeks. You will be contacted by Rooma Style Limited for more detailed delivery arrangements. Please contact our Rooma team prior to ordering a product to double check availability.

For made-to-order /custom made/personalised items we aim to deliver within 8 to 12 weeks from the point of receiving your *Made-to-Order Acceptance Notification (*see ‘Ordering & Payment above).

If a single order includes both off-the-shelf and made-to-order items, then the shipping of each item will be handled separately following the terms above.

 

Backorders

If an item is out of stock at the time of ordering, then we will either wait for the whole order to be in stock so we may ship all together, or if there will be an extended delay then we may ship a partial order, with the balance to follow.

Once a back order comes into stock, we will send the item out automatically, so if you change your mind about an item that you have pre-ordered, then it is your responsibility to cancel the order.

If a back-order is older than 3 months, we will contact the customer to ask if goods are still required and inform of expected delivery date, if available, at this time if goods are not required the back-order items will be cancelled.

Cancellation

You have the legal right to cancel your order within seven working days of receiving the goods under the Distance Selling Regulations.  Should you wish to do so, please contact customer services on [email protected] within seven working days of receiving your parcel.   If your order has already been despatched please follow our returns procedure.  Goods must be returned to us in the condition in which they were dispatched.  All good returned to Rooma Style Limited are done at your own cost.

Made-order-items
You can cancel your order within 7 days of placing the order up to the point where you send us your Made-to-Order Acceptance Notification. Made to order’ or ‘personalised’ or other bespoke items cannot be cancelled once we receive the Made-to-Order Acceptance Notification from you.

 

Returns Policy

‘Made to order’ items or ‘personalised’ items or other bespoke items are non-returnable and non-refundable unless faulty or damaged.

If you wish to return an item, we need to receive it back within twenty eight days of receipt for a refund or exchange. We ask that you please return the items with their original saleable packaging. This does not affect your statutory rights. As the goods are your responsibility until they reach us, please ensure you package your items well in order to prevent any damage to the items or boxes.

We recommend that you obtain a Certificate of Posting in case for whatever reason the parcel(s) fails to reach us.

With the exception of faulty and damaged goods we are not responsible for the return postage and do advise that you obtain a certificate of postage in case the parcel fails to reach us. To contact regarding a return please email [email protected]

If you wish to cancel your order and return it to us, under the Distance Selling Regulations, you must let us know within seven working days of receiving your parcel. This can be done by calling us 01769 540022 or via email at [email protected] . You will then need to return the whole order to us, at your own expense if you have already received it.  Once we receive the whole order back we will issue a full refund of the item price that you paid. We cannot refund the the original delivery charge unless the item is faulty or damaged.

Please note that it can take up to 21 days to process a return.

We cannot be responsible for interest charges made by your credit card company whilst waiting for returns to be refunded to your card.

Bespoke and Made-to-order Items

In addition, if you wish to purchase a ‘made to order’ or ‘personalised’ or other bespoke item,  the order cannot be cancelled once it has been placed.

‘Made to order’ items or ‘personalised’ items or other bespoke items are non-returnable and non-refundable unless faulty or damaged.

‘Made to order’ items must be checked for damage and signed for upon delivery.

If a bespoke item is either faulty, damaged or is an incorrect item, you must notify the delivery person at the time and they will notify us. The item must be returned within seven days of delivery.  You must contact our customer care team either by email [email protected] or by telephone 01769 540022 within seven working days from date of delivery.

Saved Baskets

If you have added items to your basket and saved the basket, the basket will remain saved for up to one month. If this saved basket is not converted into a transaction, the basket will be emptied.

Law

Every purchase you make shall be deemed performed in England. These Terms and Conditions shall be governed, construed and interpreted in accordance with the laws of England and Wales.

Rooma Style Limited does not accept liability for any indirect or consequential loss arising out of the use of the website or for any products or services purchased from the website.

Rooma Style Limited will only be liable for direct loss up to a maximum total of the price of the product or service purchased in respect of any claim. This Liability section applies only to the extent permitted by law. By placing an order you are agreeing to these terms.
